Lawsuit 1

In 2023, a class action lawsuit was filed against Lume Deodorant LLC.

The lawsuit’s claims

“This statement is false and misleading because the study relied on only evaluating the Product compared to competitors and concluded it was superior to them, not that it blocked odor all day nor continued to control odor for 72 hours.”

“The sample sizes were neither large nor diverse enough to prove the Product blocked odor all day nor continued to control odor for 72 hours, notwithstanding the results only could establish relative claims.”

“Consumers expect a “clinically proven” claim to mean a significant degree of scientific consensus and/or that the relied upon study was subject to peer-review, even though neither exists here.”

“The Product’s claim to be “aluminum free” is misleading because aluminum is not found in any deodorant products.”

Lawsuit Result

Lume Deodorant Lawsuit Voluntarily Dismissed December 13, 2023.

On November 21, 2023, Lume Deodorant LLC asked for an extension to “have sufficient time to analyze the background of this action” and to “determine if the parties can avoid motion practice and properly respond” to the class action lawsuit.

The plaintiff dropped the case the next month, but in their notice of dismissal, they did not state the reason why they dropped the lawsuit. (Source)

See my review of Lume Deodorant here.

Changes to Lume’s Marketing

They used to say in 2023 “clinically proven to block body odor all day and continue to control odor for 72 hours.”

Lume continues to market its deodorant as lasting for 72 hours. They say as of June, 2024, regarding the stick deodorant, that it has “clinically proven 72-hour Odor Control.”

The current wording does not say it blocks body odor all day, only that it provides odor control for 72 hours. Meaning there is still some effect 72 hours later.

It’s not confirmed that this change is a result of the lawsuit or simply a change in their marketing strategy.

Testing Results

They say in 2024, “We performed our clinical testing through the third-party independent testing center, Princeton Consumer Research. They test brands in a double-blinded fashion worldwide and are compliant with standards set within their industry.”

Note that Princeton Consumer Research is not affiliated with the University of the same name. This is a for-profit lab that companies pay to send their products to in order to test their claims.

In 2023, Lume used to provide a page on the clinical testing (which I no longer see on the website) which can be viewed here.

On this page in 2023, they claim the deodorant worked better than Schmidts and Native, and that the deodorant’s effects lasted up to 72 hours.

Aluminum Claim

The lawsuit reported that “the Product’s claim to be “aluminum free” is misleading because aluminum is not found in any deodorant products.”

Aluminum is generally only found in antiperspirants, not deodorants, except for the aluminum found in Kaolin clay used in some deodorants, which Lume does not use.

Lume still advertises their deodorant as aluminum-free as of the writing of this article in 2024.

I do think many people are still interested in that aluminum-free claim since the distinction between the already determined definitions of deodorant versus antiperspirant may not be obvious to consumers.

Lawsuit 2

In February 2022, Dilenia Paguada filed an accessibility lawsuit against Lume Deodorant.

Paguada alleges that www.Lumedeodorant.com is not accessible to blind and visually impaired customers and, thus, violates Title III of the Americans with Disabilities Act.

In May, 2022, the plaintiff and/or their counsel, gave notice that the case is voluntarily dismissed, with prejudice and without costs against the defendant Lume Deodorant, LLC.

Context

In 2021, new rules came in to make websites more accessible but most small websites did not know about this and were unprepared.

Many law firms took this opportunity to sue small sites for accessibility and many won. I know other bloggers who were sued.

Accessibility of a site has to do with the ability of site reader software to read the site as well as things like the contrast between words and the background. Some of it gets quite technical.

When a website is accessible it means it is accessible to people with a diverse range of hearing, movement, sight, and cognitive ability.

See my review of Lume Deodorant here. Want a totally natural option? The deodorant I actually use is Routine Deodorant, reviewed here (it works).

I am considering filing a lawsuit against Lume. My husband and I tried Lume for about 2 weeks. We both saw our underarms start to turn red and then the skim literally peeled off leaving permanent scarring. I have never had a reaction from any deodorant like this in my lifetime. Now, I have large dark areas under my arms with a little bulge and my husband has big black spots under his. Someone needs to be held accountable! Janice Moore

You will all get what you deserve for responding to such a vulgar woman and her grossly described products. The first time she popped up on my TV, she disgusted myself and my family. I have since cancelled my television package with Verizon due to this type of advertisement constantly assaulting my family in my home – among other things..! If Klingman put no thought into how she affects people in this manner, then I can imagine how she is with her alleged “patients” and those putrid products. She should be sued left, right and sideways just on the revulsion factor alone.

don’t ever use anything IN your private area, Dr Klingman says this in a lot of her videos, to only ever apply products to the l**ia majora and to do a test patch if you want to use it on your l***a minora ❤️ I actually use it everywhere, including the l***a minora and in my butt crack, and I realized I SHAVED BEFORE DOING THIS AND WOW DID IT BURN LIKE HECK. Anyway, now I do not apply anything but plain Vaseline on shaving days. but after that first initial skin reaction, it’s been great….I get sweaty at work and it’s made me so confident when I go to pee after a 12-hr shift of sweating, I pull my undies down and sit and IT SMELLS LIKE ORANGES AND ROSES 😀 probably the best is I no longer feel self conscious about seeing a GYN doctor and can get much needed care without being embarrassed. I keep making new accounts to get the “new member” price, I would literally show my buttcrack if Lume paid me in their ads, that’s how much I love it LMFAO no shame as a formerly stinky sweaty woman, I hope you feel better and your reaction cleared up! if you’re keen to try again, keep it off the l***a minora (that’s the soft shiny skin down there) and only put it on the majora and see if it works

I used your products and had a severe reaction. I was unable to use any deodorant for weeks, and had to get medical attention and was prescribed an ointment. It took a couple of weeks before I was able to use deodorant of any kind. Took pictures of my under arms.

The first time I used Lume spray deodorant I broke out in blisters like second degree burns everywhere it touched me. IT WAS SO PAINFUL I couldn’t stand clothing to touch the area. It took WEEKS for it to go away and left a large scar like mark on the worst area. This is a dangerous product! The pain is excruciating and lasts for weeks! There needs to be a class action lawsuit against this company.

If it contains aluminum it means it’s an antiperspirant not a deodorant technically. that is what they meant

Wow. Talk about some frivolous lawsuits! I don’t care about your review, as it’s obviously not the best if you don’t use/recommend the product yourself. I personally use Lume and I can tell you with 100% certainty that it absolutely works for 72 hours. Will you smell shower clean down there? Not after 72 hours, of course, but you definitely smell 100% better than you would with no Lume applied. There might be just the faintest of smell after 72 hours and that is certainly NOT the case without it! After 12 hours in Florida, sweating and all that, your “undercarriage” for both men and women does NOT smell good at all! However, with Lume that isn’t the case. Now, I don’t regularly go 72 hours without a shower, but I was putting the product to the test and for me, it definitely passed the test. Living in Florida, you can’t even go 24 hours without a shower and not have any odor down there, which is probably the case for any climate, honestly. I just know that I take a shower, apply my Lume between my cheeks and between the outer/inner * and by the end of the day, I have ZERO smell at all, which was never the case before. Every person is going to have body odor down there after 12-18 hours, because it’s a warm, moist environment, which is the perfect breeding ground for odor causing bacteria, but Lume managed to eliminate that somehow and I can honestly say that I’ve never used a better product, that you could even use on your privates to control odor. I was shocked that it actually lived up to its claims and I would recommend it to anyone who likes to be without body odor, especially below the belt.

just because you had an reaction doesn’t mean it’s a bad product. like you do realize that ALL makeup, lotions, etc are NOT regulated by the FDA, right? everyone’s skin is unique to themselves. You use a product, you get a rash and you stop using it and never use it again, the end. it’s the chance you take when trying new products. I’ve even had different laundry detergents give me a rash. I’ve learned to always wash your washcloths a couple times before you use them on your face/body, as the dye in them has given my mom’s face a rash before. nobody needs to “contact you”. you don’t need to sue anyone. the product just didn’t agree with your skin and that’s not the case for everyone. I use it daily just fine.

Same here!! I had chemical burn blisters everywhere it touched! They will just tell you that you used it wrong. It’s spray deodorant. It’s not rocket science, you spray it on! Then they will stop responding. This product is dangerous and their “customer service” is a joke!

I cannot believe that people would sue over any of the above claims. It is sad that so many lawyers go after small businesses. It is hard enough to make it in business. How about calling and working together to fix it. Everyone is always after getting a pay day. These pay days ruin small businesses. I do not own a small business. I have friends and neighbors who do and they are being destroyed.
